Will of Henry Flesher, 1734-1803

In the name of God, Amen, I Henry Flesher, Senior, of Harrison County, and State of Virginia am of perfect mind and memory thanks be given unto God. Calling to mind the mortality of my body and knowing that it is appointed for all men one to die do make and ordain this my Last Will and Testament, that is to say; principally and first of all I give and recomend my soul unto the hand of Almighty God that it and my body, to be buried in a decent Christian burial and as touching such worldly estate I give and bequeath to Elizabeth my wife her bed and furniture That belongs to said bed. Andrew and Peter my three sons they have each the share and my son Henry is to have the plantation whereon I now live beginning at the upper corner tree, thence running over the river to Peter Flesher's corner, then with the meanders of the river to the mouth of Stone Coal Creek, then up said creek with the meanders thereof to the upper end of Apoplaw bottom to a small dreen and up the same to the line--and my son John I give the tract of land on Poke Creek lying between Peter Flesher's line and John P. Dewallading----thereto Sixty Dollars in cash out of my movable and to my son William I give the land lying on the lower side of Stone Coal Creek as the line runs joining with Charles Parsons adding thereto to him Fifity Dollars and the old sand mares Colt----and as for all the remainder of my estate movable shall be sold at public sale and eighteen months credit given and then my wife Elizabeth to have her thirds of the money when my debts is paid and the balance to be divided equal amongst my four daughters Ann, Elizabeth, Mary and Susannah but as for my Son Henry he shall pay to John & William each Eighty Dollars in hand for their part of the old plantation as soon as they become the age of twenty-one years but as for William he shall be bound to traid at the age of seventeen and I also appoint My sons Adam and Henry Flesher as my executors and administrators then shall also be reducted three pounds out of my daughter Susannah's share for the land she now lives on Murphy's Creek and I do herby utterly revoke and dizannul all and every former will and testament in anywise before named. In witness whereof I have hereunto set my hand and seal this twenty-sixth day of November One Thousand Eight Hundred and Two. James Wallis

[Walful.FTW] JAMES WALLIS WILL Book 4A Page 144 Russell Co VA Court House Records I, James Wallis of Russell County and State of Virginia do hereby make my last will and testament in manner and form following, that is to say: 1st. I desire that so much of the perishable part of my estate be immediately sold after my decease, and out of the money arising there from all my just debts and funeral expense be paid. Should the perishable part of my property prove insufficient for the above purpose then I desire that my executor here in after named may sell my house and land lying in the County and State aforesaid, and out of money arising there from pay and satisfy such of my just debts as shall remain unpaid out of the sale of the perishable part of my estate. 2nd. After the payment of my debts and funeral expense I give to my wife Mary Wallace a Sorrell horse and to have a maintenance from my farm and the use of my house during her widowhood or natural life. 3rd. I give to my daughter Susannah (which she now has in possession) one bed and furniture a cow and calf, one oven and one flax wheel. 4thly. I give to my daughter Margaret (which she now holds in possession except one oven) one bed furniture one cow and calf, one oven and flax wheel. 5thly. I give to my daughter Jane, one bed and furniture, one cow and calf, one oven and flax wheel. 6thly. I give to my daughter Nancy Lou (or Lea), one bed and furniture, one cow and calf, one oven and a flax wheel. The furniture of the beds I give to my daughters shall be equal to the furniture of bed I gave to my daughter Susanah. 7thly. After the decease of my wife I desire that my land other property remaining shall be equally divided among my three sons, William, Logan, and James. 8thly. I give my son James my bright bay mare, and lastly, I do hereby constitute my two sons William and Logan executors of my last will and testament hereby revoking all other former wills or testaments by me here to fore made. In Witnesseth where of I have here unto set my hand and affix my seal the 16th day of September 1824. McFarlane Virginia At a Court held for Russell County on the 5th day of October 1824 This instrument of writing was exhibited in Court as and for the last will and testament of James Wallis deceased and proven by the oaths of John Fletcher and James M. McFarlane the subscribing witnesses thereto and ordered to be recorded. And on the motion of William Wallis and Logan Wallis Exec. therein named, who made oath, and together with John Fletcher, Henry Fuller and Samuel Bromley their securities entered into and acknowledged a bond in the penalty of $500 conditioned as the law directs, certificate is granted the said William Wallis & Logan Wallis for obtaining probate of the said will in due form. Will of Balser Flesher

Court of Common Pleas July Term 1833, and now to wit, on the 10th day of August 1833 the last will and testament of Balser Flesher decd is ___ and partially proved on the oath of Robert J. Smith one of the subscribing witnesses thereto, and whereas at a Special Court of Common Pleas held on the 21st[?] day of August 1833, the last will and testament of said Balser Flesher deceased being fully proved on the oath of John Roberts one of the other subscribing witnesses thereto from whose testamony and that of Robert J. Smith heretofore received in open Court at last term, it appears that said will was duly executed and that the testator at the time of executing the same was of full age and of sound mind, memory and understanding and not under any restraint and that the said deceased requested that said John to sign the same as a witness. Therefore the said will is to be recorded and that letters of testamentary issue to David Sherrard the executor named in said will who appeared in open Court and is ___ as such and it is ordered that he give bond in the sum of $1000. John Roberts and Daniel Bush are accepted as securities ___.

I Balser Flesher being weak in body but of strong and perfect mind and memory blessed to Almighty God for the same, do make and publish this my last will and testament in manner and form following:
First, I give and bequeath unto my beloved wife Mary Flesher all my personal estate during her natural life and at her decease it is to be sold at publick [sic] sale and ten dollars of the money I give and bequeath unto my grand daughter Margaret Lamb and the balance to be awarded equally between my sons and daughters Catharine Aldridge, Sarah Daugherty, Ann Drum, Mary Shaw, Matilda Baird, Henry Flesher, John Flesher, and Peter Flesher. I further give and devise to my youngest son Peter Flesher, his heirs and assigns all the tract of land that I now live on containing two hundred and three acres to the same more or less the bounds being designated on a plat made out by John Roberts Feb 19th 1830 being a part of the second quarter first Township eighth Range military. The said Peter to have full possession of the same at mine and my wife's decease, and not before. I also order and will that the tract of land that Grace Drum now lives on of fifty two acres which was surveyed by John Roberts and the courses and distances designated on said plat shall be sold and private or publick [sic] sale by my executor and fifty dollars of the proceeds thereof to be paid within one year after the sale of said land to my daughter Ann Drum, fifty dollars to my daughter Mary Shaw, and fifty dollars to my daughter Matilda Baird, and the balance after my just debts is paid to be equally divided between the above named sons and daughters. And lastly I do hereby appoint David Sherrard as Executor of this my last will and testament hereby revoking all former wills by me made. In witness whereof I have hereunto set my hand and seal the twenty first day of October in the year of our Lord one thousand eight hundred and thirty.
